The service known as "Bideal24" is provided online as a Software-as-a-Service (SaaS) by the entity Bideal24. The utilization of Bideal24 is governed by the following terms and conditions. Utilizing Bideal24 implies agreement to these terms and conditions. Any deviation from these terms and conditions can only be validated through a written approval from Bideal24.
The Bideal24 service enables you to design online forms for third-party completion and to manage the outcomes for online viewing. It is your responsibility to decide which information you wish participants to provide and how you intend to use the collected results. Registration is required to access Bideal24. Once registration is complete, you can immediately access your account and begin using the service. You are responsible for securing your account access, specifically using your email address and password, against unauthorized use by others. It is crucial to maintain the confidentiality of your password. Bideal24 will consider all activities conducted from your account, following login with your email address, as having been authorized and overseen by you. This implies your accountability for such activities, up until the point you inform Bideal24 that your password has been compromised. Bideal24 facilitates the processing of personal data, acting in the capacity of a processor as defined under the Dutch Data Protection Act; you act as the controller. You agree to defend and exonerate Bideal24 from any third-party claims related to this Act.
Utilizing Bideal24 in any manner that contravenes Dutch or relevant international laws or regulations is strictly prohibited. This prohibition extends to (but is not limited to) the storage or dissemination of data through the service that could be deemed defamatory, libelous, or racially offensive. Specifically, it is forbidden to solicit personal data without having instituted a comprehensive privacy policy. All personal data processing must adhere to the Dutch Data Protection Act. Should Bideal24 identify or be informed of any breach of these stipulations, Bideal24 reserves the right to take action to halt such breaches. If Bideal24 believes that its own computer systems or those of third parties could be, or are at risk of being, compromised or damaged—such as through the excessive sending of emails or other data, breaches involving personal data, or virus dissemination—Bideal24 may implement whatever measures it considers necessary to prevent or mitigate such threats or damages. Bideal24 retains the authority to initiate legal proceedings against any illegal activities conducted through or with the aid of the service. Bideal24 is entitled to seek compensation for any harm it endures due to breaches of these usage terms. You are obliged to indemnify and protect Bideal24 against any claims made by third parties as a result of your infringement of these terms of use.
Bideal24 commits to making the service accessible continuously, although it does not promise uninterrupted service availability. Bideal24 conducts regular maintenance of Bideal24. This maintenance can occur at any moment and might affect the service's accessibility. Whenever feasible, maintenance will be communicated beforehand. Bideal24 occasionally updates and modifies Bideal24. While your input and recommendations are appreciated, the decision on which changes to implement rests solely with Bideal24.
The Bideal24 service, its associated software, and all information and images on the website constitute the intellectual property of Bideal24. These materials may not be replicated or utilized without Bideal24 express written consent, except as allowed under compulsory law. The information you upload or handle through the service remains your own (or that of your suppliers or licensors). Bideal24 is granted a limited license to employ this information for the service, including its future functionalities. This license can be revoked by you at any time by deleting the relevant information and/or ending the contract. When you submit information to Bideal24, such as a bug report or a suggestion for enhancement, you provide Bideal24 with a continuous, unlimited license to use this information for improving the service. This does not apply to data you specifically designate as confidential. Bideal24 commits to not accessing the data you store or transmit via Bideal24, unless it is necessary to ensure quality service provision or Bideal24 is compelled by law or a directive from a relevant authority. In such instances, Bideal24 will endeavor to minimize access to the information as much as possible.
Utilizing specific features of Bideal24 incurs charges. These chargeable features will notify you of their respective fees. The fee is billed monthly and must be settled in advance. Payments can be made via credit card, or through other methods detailed on the website. Given that the service commences immediately upon your explicit request, payments are not refundable under the Distance Selling Act.
Except in instances of deliberate wrongdoing or severe negligence, Bideal24 liability is restricted to the total amount you have paid in the three months preceding the event causing the damage. Bideal24 is not responsible for any indirect damages, subsequent losses, loss of profits, missed savings, or damages due to business disruption. Claims for damages must be submitted in writing to Bideal24 no later than two months following their discovery. Bideal24 bears no liability for any trading activities conducted. In the event of force majeure, Bideal24 is not obligated to compensate for any damages incurred by you. Force majeure encompasses, but is not limited to, disruptions or unavailability of the internet, telecommunications infrastructure, electricity outages, civil unrest, traffic congestion, labor strikes, business disturbances, supply chain interruptions, fires, and floods.

This contract becomes effective the moment you start using the service and continues to be in effect for a month. Subsequently, the contract is automatically renewed for additional periods of the same length. If you are a consumer, after the initial automatic renewal, you have the right to cancel the contract at any time with a one-month notice period, starting from the day you notify. Non-consumers have the option to end the contract at the conclusion of the current term, adhering to a one-month notice period. Bideal24 reserves the right to terminate the contract if you have not utilized the service for a continuous period of 18 months. Before doing so, Bideal24 will send a reminder email to the email address associated with your account. Upon request and for an extra fee, Bideal24 can provide you with a copy of the data you've stored through the service. Bideal24 reserves the right to modify or supplement these terms and conditions, as well as any pricing, at its discretion. Bideal24 will notify users of any changes or additions through the service, at least thirty days prior to their implementation. Should you disagree with any proposed changes or additions, you have the option to terminate the contract up until the effective date of those changes. Continuing to use Bideal24 beyond the effective date will be considered as your agreement to the updated or expanded terms and conditions.
This agreement is governed by Dutch law. Unless mandatory law specifies otherwise, any disputes related to Bideal24 will be resolved in the competent courts located in the region where Bideal24 main office is situated. For any provision in these terms and conditions that requires a statement to be made "in writing" for it to be legally effective, an email or a message sent through the Bideal24 service is considered adequate, as long as the authenticity of the sender can be verified with reasonable certainty and the integrity of the statement remains intact. The record of any communication or information as kept by Bideal24 will be regarded as accurate, unless you can provide evidence proving otherwise. Should any section of these terms and conditions be deemed legally void or invalid, it does not affect the validity of the entire agreement. In such cases, the parties will agree on one or more substitute clauses that closely reflect the original purpose of the invalid or void provision(s), within legal bounds. Bideal24 reserves the right to transfer its rights and responsibilities under this agreement to another party in the event of a sale or transfer of Bideal24 or its business activities.
